Snus and Nicotine Pouches in California
California has the most restrictive state-level laws governing flavoured tobacco and nicotine products in the United States. A statewide ban on flavoured tobacco products, which now explicitly covers nicotine pouches, snus, and products containing synthetic nicotine, has effectively removed almost every flavoured oral nicotine product from retail shelves and online delivery to California addresses.

The California Flavour Ban – How It Works
SB 793 and Proposition 31
The foundation of California's flavour restrictions is Senate Bill 793, passed in 2020. SB 793 banned the retail sale of most flavoured tobacco products in California, including flavoured nicotine pouches. After a legal and political challenge delayed implementation, California voters upheld the law via Proposition 31 in November 2022. The ban took full retail effect in December 2022.
Under SB 793, a flavoured tobacco product is defined as any tobacco product containing a constituent that imparts a characterising flavour, covering mint, menthol, wintergreen, citrus, fruit, berry, coffee, cinnamon, and any similar characterising taste or aroma. Tobacco-flavoured products are exempt.
AB 3218 and SB 1230 – The 2025 Expansion
Two further pieces of legislation, effective from January 1 2025, significantly expanded the scope and enforceability of the original ban.
Assembly Bill 3218 closed the most significant loophole: it expanded the definition of tobacco products to explicitly include synthetic nicotine and nicotine analogs. Before this, products using non-tobacco-derived nicotine, including ZYN, which uses pharmaceutical-grade nicotine, had a potential argument that they fell outside the scope of SB 793. AB 3218 removed that argument entirely. AB 3218 also extended the sales ban explicitly to online retailers and delivery sales, prohibiting any seller from shipping flavoured nicotine pouches or snus to a California address, regardless of where the retailer is based.
Senate Bill 1230 introduced the Unflavored Tobacco List (UTL), a definitive, state-maintained list of tobacco and nicotine products approved for sale in California. Any product not on the UTL is deemed a prohibited flavoured product by default. Manufacturers must submit a legally binding declaration that their product contains no characterising flavour in order to be listed.
The California Attorney General published the inaugural UTL on December 31 2025. Only products appearing on this list may be legally sold at retail or shipped to California addresses.
What Can You Still Buy in California?
Nicotine Pouches
The practical effect of the UTL is that almost all flavoured nicotine pouches, including the entire mainstream product ranges of ZYN, On!, VELO, Rogue, Lucy, and every other major brand, cannot be legally sold at retail or shipped to California.
The only nicotine pouch products eligible for sale in California are those appearing on the UTL as unflavoured. As of the UTL's publication, ZYN Smooth is the primary unflavoured nicotine pouch confirmed for the list. ZYN Smooth delivers nicotine without any added flavour character and is available in 3mg and 6mg.
The position of ZYN Chill (also marketed as ZYN Original in some contexts) is more complex. Public health advocates have argued that the FDA's own January 2025 Marketing Granted Order decision classified ZYN Smooth and ZYN Chill as having characterising flavours, and have called for their removal from the UTL. The status of these products should be verified against the current published UTL at the California Attorney General's website before purchasing.
No flavoured ZYN products, including Cool Mint, Spearmint, Citrus, Wintergreen, Menthol, Coffee, Cinnamon, Apple Mint, or Blackcurrant Ice, are legally available for retail sale or online delivery in California.
Snus
For traditional snus, the California ban applies equally. Flavoured General Snus products, General Snus Mint, General Snus Wintergreen, General Snus Mini Mint, and General Snus Nordic Mint, cannot be legally sold at retail in California under the flavour ban.
General Snus Original (Portion and Loose) and General Snus White Large are unflavoured or tobacco-flavoured products. Whether these appear on the California UTL should be confirmed against the current published list.
No other snus brand has FDA authorisation for US commercial sale regardless of California's state-specific rules.

Can You Order Nicotine Pouches Online in California?
As of January 1 2025, AB 3218 extended the California flavour ban to cover online sales and delivery. An out-of-state retailer shipping flavoured nicotine pouches to a California address is facilitating an illegal sale under California law, even if the retailer is not based in California.
For UTL-listed unflavoured products, compliant online retailers can legally ship to California addresses subject to standard PACT Act requirements: age verification (21+) at checkout and adult signature upon delivery.
Can You Bring Flavoured Pouches from Another State?
Personal importation for your own use, travelling to another state and returning with flavoured nicotine pouches, is a separate legal category from commercial sale and delivery. Currently, there is no California law prohibiting an individual from bringing flavoured pouches into the state for personal use. However, receiving them via delivery from an out-of-state retailer falls under the online sales prohibition.

Why Is California's Law So Much Stricter Than Other States?
California has a long record of leading tobacco control legislation ahead of federal action. SB 793 was among the first statewide bans on flavoured tobacco in the US, and the state has consistently moved to close loopholes that other jurisdictions leave open.
The UTL mechanism is particularly far-reaching because it inverts the regulatory default: instead of products being assumed legal until proven harmful, every product is assumed non-compliant unless it has been affirmatively listed as unflavoured. This places the compliance burden entirely on manufacturers and shifts enforcement from case-by-case product assessment to list-checking.
The practical consequence for California nicotine pouch users is a market that is narrower than any other US state, limited to unflavoured products only, from a short list of manufacturers who have pursued UTL listing.
What Are California Nicotine Pouch Users Doing?
The most common responses among adult users in California affected by the flavour ban fall into three categories.
Switching to unflavoured ZYN Smooth. For existing ZYN users, the transition to Smooth 3mg or 6mg keeps the format identical while removing the flavour component. Users accustomed to mint or wintergreen typically report an adjustment period of one to two weeks before the unflavoured format feels normal.
Purchasing in other states. Californians who travel regularly, to Nevada, Arizona, or Oregon, for example, report purchasing flavoured pouches in those states for personal use. This is legal under current California personal use rules.
Exploring nicotine replacement therapy. The California flavour ban has reportedly increased interest in FDA-approved nicotine replacement products (patches, gum, lozenges), which are not subject to the flavour ban and are sold with health benefit claims that nicotine pouches are not permitted to make.

California was among the first states to set a 21+ minimum purchase age for tobacco products, and the federal Tobacco 21 law confirmed this as the national standard in December 2019.
