Snus and Nicotine Pouches in Colorado

Colorado has no statewide flavour ban on nicotine pouches, multiple legislative attempts to pass one have failed. But that statewide picture is misleading on its own, because Colorado has become the epicentre of local flavour bans in the United States. Fourteen municipalities, led by Denver and a cluster of mountain resort towns, have enacted their own bans on flavoured tobacco and nicotine products, including nicotine pouches. Where you are within Colorado determines what you can actually buy.

No statewide ban — but 14 cities disagree. Denver and 13 mountain towns ban flavoured pouches locally; a 56% state excise tax (rising to 62% in 2027) applies everywhere.

Colorado also carries one of the highest state excise taxes on nicotine and vapour products in the country at 56% of the manufacturer's list price, climbing to 62% in 2027. And in a detail that captures the contradiction at the heart of Colorado's nicotine policy, Philip Morris International is building a $600 million ZYN manufacturing facility in Aurora, creating 500 direct jobs and an estimated $1 billion in economic impact, even as the city of Denver, less than 15 miles away, enforces a complete ban on the flavoured ZYN varieties the plant exists to produce.

This page explains exactly what's legal where, the tax situation, and what Colorado nicotine pouch users need to know.

Are Nicotine Pouches Legal in Colorado?

Statewide, yes, without restriction. Colorado has no statewide flavour ban on nicotine pouches. Multiple legislative attempts to create one, including SB24-022, have not resulted in a statewide ban being enacted. The minimum purchase age is 21, consistent with federal Tobacco 21 law, with no military or other exceptions.

Locally, the picture is different. As of early 2026, 14 Colorado municipalities have passed their own flavoured tobacco and nicotine bans, and these local ordinances do apply to flavoured nicotine pouches specifically, not just vapour products.

Where Are Flavoured Nicotine Pouches Banned in Colorado?

Denver – The Largest Local Ban

Denver's flavoured tobacco and nicotine ban was passed by City Council in an 11-1 vote in December 2024. The ordinance prohibits any nicotine delivery product that "masks" the flavour of pure tobacco, covering flavoured vapes, menthol cigarettes, flavoured cigars, and flavoured nicotine pouches.

A citizen-led ballot initiative to repeal the ban qualified for the November 2025 ballot. Voters decisively rejected the repeal, with 71.5% voting to uphold the ban via Referendum 310. The ban took full effect on January 1 2026, with the Denver Department of Public Health and Environment moving directly to active enforcement, issuing fines and licence suspensions to retailers found selling flavoured products, because the ballot timeline did not allow for the originally planned "soft enforcement" grace period. Approximately 575 to 600 Denver retailers are affected.

ZYN's flavoured varieties, Cool Mint, Spearmint, Citrus, Wintergreen, Coffee, Cinnamon, and Menthol, are all illegal for retail sale within Denver city limits under this ordinance. Only unflavoured products (ZYN Smooth) remain compliant.

The Mountain Town Cluster

Outside Denver, Colorado's local flavour ban movement has concentrated heavily in mountain resort communities. As of 2026, the following towns have enacted bans: Aspen, Boulder, Breckenridge, Carbondale, Dillon, Edgewater, Eagle, Frisco, Glenwood Springs, Golden, Keystone, Silverthorne, and Snowmass Village.

Several Summit County towns, Dillon, Frisco, Keystone, and Silverthorne, coordinated their bans together following a push from Summit County Public Health, with ordinances taking effect January 1 2026. Eagle became the 14th Colorado municipality to pass a ban in August 2025, also targeting a January 2026 effective date.

What's Notably Not Banned (Yet)

Outside Denver and these specific mountain communities, Colorado has no local flavour restrictions on nicotine pouches. Colorado Springs, Fort Collins, Pueblo, Greeley, and the broader Front Range outside Denver proper currently have no flavoured nicotine pouch ban in effect.

Colorado's Tobacco and Nicotine Tax

Colorado applies a 56% excise tax on the manufacturer's list price of tobacco and nicotine products under Proposition EE, the 2020 ballot measure that established Colorado's modern tobacco and nicotine tax structure. This rate is scheduled to climb to 62% in July 2027. Combined with standard state and local sales taxes, Colorado's effective tax burden on nicotine pouches is among the highest in the country, comparable in practical impact to states like Illinois, though calculated differently from Washington's even higher 95%-of-selling-price model.

The price impact is significant and well documented locally: a 5-can roll of ZYN that retails for $15 to $25 in neighbouring Wyoming, which has no comparable nicotine product tax, costs approximately $45 to $60 in Colorado. This roughly threefold price difference has created a documented pattern of Colorado residents near the Wyoming border purchasing pouches out of state.

The Philip Morris Aurora Plant

In a development that captures the tension running through Colorado's nicotine policy, Philip Morris International is constructing a $600 million ZYN manufacturing facility in Aurora, a Denver suburb. The project is expected to create 500 direct jobs and generate an estimated $1 billion in economic impact for the state. Colorado state officials offered tax incentives to attract the project, citing the state's skilled workforce as a key factor in PMI's decision.

The facility will manufacture ZYN products for distribution nationally and likely internationally, including, notably, the flavoured varieties that cannot be legally sold within Denver city limits, a short drive from the plant itself. PMI representatives have actively opposed local flavour bans at council meetings in towns like Eagle, arguing that "flavors are not a marketing trick" but are "essential to helping adult smokers switch" to nicotine pouches from combustible tobacco.

This dynamic, a major manufacturing investment in Colorado alongside an expanding patchwork of local bans on the manufacturer's own flavoured products, is a useful illustration of how fragmented and locally contested Colorado's nicotine pouch regulatory environment has become.

What Nicotine Pouches Can You Buy in Colorado?

Outside Denver and the 13 other banned municipalities, the full mainstream US range is available without restriction, subject to the state's 56% excise tax.

Buying Nicotine Pouches Online in Colorado

Online delivery to most Colorado addresses is legal for compliant retailers, subject to standard PACT Act requirements: age verification at checkout (21+) and adult signature on delivery, plus collection of Colorado's 56% state excise tax.

For addresses within Denver or one of the 13 other municipalities with active flavour bans, a compliant retailer should not ship flavoured nicotine pouches to those addresses, since the local restriction applies regardless of the retailer's own location. Unflavoured products remain shippable to any Colorado address.

Where to Buy Nicotine Pouches In-Store in Colorado

Denver
Within Denver city limits, retail availability is restricted to unflavoured products under active enforcement as of January 2026. Some local retailers have reported pivoting toward broader smoke shop inventory, cigars, tobacco-less devices, and other product categories, to offset lost flavoured nicotine sales. Buyers should expect ZYN Smooth and similarly unflavoured options at compliant Denver retail; flavoured ZYN is not legally stocked.
Aurora and the Denver Suburbs
Most Denver suburbs outside the city’s formal limits, including Aurora itself, home to the new PMI manufacturing facility, are not currently subject to Denver’s local ban and retain access to the full flavoured range, subject to the 56% state tax.
Colorado Springs and the Front Range
Colorado Springs, Pueblo, and most of the Front Range corridor outside metro Denver have no local flavour restriction. Full mainstream brand availability across pharmacy, convenience, and grocery retail, subject to standard state tax.
Mountain Resort Towns
Aspen, Boulder, Breckenridge, and the Summit County cluster (Dillon, Frisco, Keystone, Silverthorne) restrict sales to unflavoured products under their local ordinances. Retailers in these towns report meaningful revenue impact, with some specifically citing nicotine pouches as a significant share of lost flavoured sales given the documented trend of users switching from chewing tobacco to pouches in these communities.
Fort Collins and Northern Colorado
No local flavour ban currently in effect. Full range available through standard retail, subject to state tax.

Frequently Asked Questions

Is ZYN banned in Colorado?

Not statewide. Flavoured ZYN remains legal across most of Colorado, subject to the state's 56% excise tax. It is banned specifically within Denver and 13 mountain resort towns that have passed their own local ordinances. ZYN Smooth (unflavoured) is compliant everywhere in Colorado.

Why is ZYN banned in Denver if it’s being manufactured nearby in Aurora?

Denver's flavour ban, upheld by 71.5% of voters in the November 2025 Referendum 310, restricts retail sale of flavoured nicotine products within Denver city limits specifically. The new Philip Morris manufacturing facility in Aurora produces ZYN for national and broader distribution, it is not exempt from local retail restrictions, and Aurora itself is a separate municipality from Denver that has not enacted its own ban.

How much does ZYN cost in Colorado compared to other states?

Colorado's 56% state excise tax makes nicotine pouches noticeably more expensive than in low-tax neighbouring states. A 5-can roll of ZYN typically costs $45 to $60 in Colorado, compared to roughly $15 to $25 for the same product in Wyoming.

Which Colorado cities have banned flavoured nicotine pouches?

As of 2026: Denver, Aspen, Boulder, Breckenridge, Carbondale, Dillon, Edgewater, Eagle, Frisco, Glenwood Springs, Golden, Keystone, Silverthorne, and Snowmass Village.

Can you order flavoured nicotine pouches online if you live in Denver?

A compliant retailer should not ship flavoured nicotine pouches to a Denver address while the local ban remains in effect, regardless of where the retailer itself is located.
