Snus and Nicotine Pouches in New Jersey

New Jersey is a fully open market for nicotine pouches, including flavoured ones. This is a genuinely useful distinction to understand: New Jersey does have one of the country’s longer-standing flavoured tobacco restrictions, in effect since April 2020, but the law was written specifically to cover vapour products, e-cigarettes and liquid nicotine, and explicitly does not extend to snus or nicotine pouches. The full flavoured range of ZYN, On!, VELO, Rogue, and other brands is legally available across New Jersey retail and online.

This puts New Jersey in sharp contrast to its immediate neighbour Massachusetts to the north, where flavoured nicotine pouches are banned outright, and gives New Jersey buyers, including those near the Pennsylvania and New York borders, a genuinely unrestricted market close to states with much tighter rules.

Are Nicotine Pouches Legal in New Jersey?

Yes, without restriction on flavour, brand, or strength. New Jersey has no statewide ban on flavoured nicotine pouches or snus. The full mainstream range, ZYN, On!, VELO, Rogue, and others, is legally available at retail and through compliant online delivery, in any flavour and any strength currently sold in the US market.

The minimum purchase age is 21, consistent with federal Tobacco 21 law, with no state-specific exceptions.

New Jersey's Flavour Ban

What S3265 Actually Restricts

On January 21 2020, Governor Phil Murphy signed S3265, prohibiting the sale of all flavoured vapor products, including menthol, except tobacco flavour. The law took effect April 20 2020. New Jersey's statutory definition of "vapor product" is specific: a non-combustible device using a heating element, power source, electronic circuit, or other electronic, chemical, or mechanical means to produce vapour from nicotine. This is, by definition, an electronic device category.

Nicotine pouches use no device, no heating mechanism, and produce no vapour. They are not vapor products under New Jersey's statutory framework, and S3265's flavour restriction does not apply to them.

New Jersey Says So Explicitly

This is one of the few states where the exclusion of pouches from the flavour ban is stated outright rather than inferred from the statutory definition. According to tracking from CASAA (the Consumer Advocates for Smoke-Free Alternatives Association), New Jersey's flavour law "does not ban low risk flavored tobacco products, such as snus", explicitly carving these products out of scope, while noting that the law also leaves flavoured combustible products like little cigars on the market.

does not ban low risk flavored tobacco products, such as snus

The practical result: flavoured snus and flavoured nicotine pouches were never within the scope of New Jersey's 2020 flavour ban, and remain fully legal for retail sale today.

New Jersey Tobacco and Nicotine Tax – What Applies to Pouches and Snus

New Jersey applies distinct tax treatments depending on product classification.

Snus – Taxed as Snuff

Traditional snus, containing ground tobacco, is taxed in New Jersey at 75 cents per ounce under the state's smokeless tobacco tax framework, alongside a broader smoke-free tobacco products tax of 30% of wholesale price applied to other smokeless tobacco categories.

Nicotine Pouches

New Jersey's liquid nicotine and vapor product tax structure, 10 cents per fluid millilitre on wholesale cost, plus a 10% retail tax on container e-liquid, is specific to liquids used in vapor devices. Nicotine pouches contain no liquid nicotine solution and are not taxed under this framework. As of this writing, New Jersey has not enacted a nicotine-pouch-specific excise tax comparable to the per-unit or wholesale-percentage taxes seen in states like North Carolina, Illinois, or Rhode Island, though New Jersey did increase taxes on cigars and other tobacco products in 2025 as part of broader revenue legislation, and nicotine pouch taxation remains an area of ongoing legislative attention nationally that New Jersey could act on in future sessions.

Buying Nicotine Pouches Online in New Jersey

Online delivery to New Jersey addresses is legal for compliant retailers carrying the full flavoured nicotine pouch range. Standard PACT Act requirements apply: age verification at checkout (21+) and adult signature required on delivery. USPS cannot carry tobacco or nicotine products; delivery is via UPS or FedEx under their respective tobacco shipping programmes.

New Jersey's online sales prohibition under S3265 applies specifically to flavoured vapor products, meaning a retailer cannot ship flavoured e-cigarettes or e-liquid to a New Jersey address, but this restriction does not extend to nicotine pouches or snus, which can be shipped to New Jersey addresses in any flavour by a compliant retailer.
