Snus and Nicotine Pouches in Tennessee

Tennessee is in the middle of a significant overhaul of its vapour product regulation, a new directory system, a dual-rate excise tax, and tougher carding requirements all took effect through 2025 and 2026. None of it touches nicotine pouches. ZYN, On!, On! Plus, VELO, Rogue, and other mainstream brands remain fully legal in Tennessee in every flavour and strength, with no flavour ban and no pouch-specific directory requirement.

This page explains what's actually changing in Tennessee's nicotine regulation, why nicotine pouches sit outside nearly all of it, and where to buy.

Are Nicotine Pouches Legal in Tennessee?

Yes, without restriction on flavour, brand, or strength. Tennessee has no flavour ban on nicotine pouches and no product directory requirement applying to them. The full mainstream US range is legally available at retail and through compliant online delivery.

The minimum purchase age is 21, consistent with federal Tobacco 21 law, with no Tennessee-specific exceptions.

Tennessee's New Vapor Product Directory

A Phased Rollout Through 2027

Tennessee's comprehensive vapour products law (HB0968/SB0763, also referenced as Tenn. Code Ann. § 57-4-101 et seq.) reshapes how vapour products are regulated, taxed, and sold in the state through a multi-phase timeline. Manufacturers were required to register each vapor product with the Department of Revenue by August 1 2025, certifying either FDA marketing authorisation or a pending PMTA submitted before September 9 2020. The Department published its public Vapor Product Directory on January 1 2026. Retailers then have 60 calendar days from that publication date to clear unlisted inventory, with full enforcement beginning January 1 2027, after which unlisted vapour products are subject to seizure, forfeiture, and destruction.

Given that the FDA has authorised only a small number of vapour products nationally, primarily tobacco- and menthol-flavoured devices from established manufacturers, this directory is expected to function as a de facto removal of most flavoured and disposable vape products from Tennessee retail once full enforcement begins.

A New Dual-Rate Vapour Tax

Effective July 1 2025, Tennessee introduced a new excise tax structure for vapour products: 10% of wholesale cost price for open-system products like bottled e-liquids and refillable devices, and $0.07 per millilitre for closed-system products like prefilled pods and cartridges. This tax is applied at the wholesaler/distributor level, in addition to Tennessee's standard 7% state sales tax plus applicable local sales tax. The new tax is projected to generate approximately $16 million in annual revenue, with 12.5% specifically allocated to the Tennessee Alcoholic Beverage Commission (TABC) to fund enforcement of the new directory system.

Why None of This Applies to Nicotine Pouches

Tennessee's statutory definition of "vapor product", covering noncombustible products that employ a mechanical heating element, battery, electronic circuit, or other mechanism to produce or emit vapour, captures e-cigarettes, e-cigars, e-pipes, and similar devices. Nicotine pouches use no such mechanism. They contain no liquid, produce no vapour, and involve no device. The directory requirement, the new dual-rate tax, and the enforcement mechanisms running through the TABC all apply specifically to the vapour product category as statutorily defined, with no application to nicotine pouches.

For Tennessee nicotine pouch buyers, the entire regulatory overhaul described above is simply not relevant. Pouches remain available exactly as before, with no directory listing requirement and no new excise tax layer.

Stricter Carding Rules – A Tennessee-Specific Detail

A separate but related provision of Tennessee's 2025 reform raised the mandatory carding threshold for tobacco, nicotine, and vapour product retailers. Effective July 1 2025, retailers must check ID for any customer who appears under 50 years old, a significantly higher threshold than the more typical "appears under 30" standard used in most other states, including for nicotine pouch sales specifically. Failing to card an undercover compliance officer who appears 35 or even 45 has been treated as a violation under the new standard.

This applies to nicotine pouch sales the same as any other nicotine or tobacco product sale in Tennessee. Buyers of any age should expect to be asked for photo ID at Tennessee retail more consistently than in most other states covered in this guide series.

Buying Nicotine Pouches Online in Tennessee

Online delivery to Tennessee addresses is legal for compliant retailers. Standard PACT Act requirements apply: age verification at checkout (21+) and adult signature required on delivery. Tennessee law additionally requires that mail distribution of vapor products specifically obtain an affirmative age statement from the recipient, a provision tied to the vapour product definition rather than pouches, though compliant retailers typically apply consistent age-verification standards across their full catalogue regardless of product type. USPS cannot carry tobacco or nicotine products; UPS and FedEx handle delivery under their respective tobacco shipping programmes.

No pouch-specific Tennessee excise tax currently applies to online orders, unlike the new dual-rate vapour tax that does apply to e-cigarette deliveries.

Where to Buy Nicotine Pouches In-Store in Tennessee

Nashville
Strong in-store availability across pharmacy chains (CVS, Walgreens), convenience stores, grocery retailers (Kroger, Publix), and gas station forecourts throughout Nashville and the surrounding metro. Memphis
Good coverage across pharmacy and convenience retail throughout Memphis and Shelby County.
Knoxville and Chattanooga
Solid availability across both East Tennessee cities through standard pharmacy and convenience retail.
Clarksville and Fort Campbell

Wintergreen and mint products from ZYN and On! are particularly well stocked in this corridor.
Rural Tennessee
Availability narrows in smaller towns across rural Tennessee, with gas stations and general stores typically carrying ZYN and occasionally On! in popular flavours. Online delivery is the more reliable route to the full range in these areas.

Frequently Asked Questions

Are nicotine pouches banned in Tennessee?

No. Tennessee's new vapour product directory and tax law applies specifically to electronic vapour devices and e-liquids, nicotine pouches are entirely outside its scope and remain fully legal in every flavour.

Does Tennessee’s vapor product directory affect ZYN or other nicotine pouches?

No. The directory requirement applies only to products meeting Tennessee's statutory definition of "vapor product", devices using a heating element or electronic mechanism to produce vapour. Nicotine pouches use no such mechanism.

Why do I need ID to buy nicotine pouches in Tennessee even though I’m clearly over 21?

Tennessee raised its mandatory carding threshold to anyone appearing under 50 years old, effective July 1 2025, a notably stricter standard than most states. This applies across tobacco and nicotine product sales generally, including nicotine pouches.

Are nicotine pouches taxed in Tennessee?

Not currently with a pouch-specific excise tax. Tennessee's new dual-rate tax (10% wholesale for open-system, $0.07/mL for closed-system) applies to vapour products only, not to nicotine pouches.

Can you order nicotine pouches online in Tennessee?

Yes. Compliant retailers can ship the full flavoured range to Tennessee addresses under standard PACT Act requirements, age verification (21+) at checkout and adult signature on delivery.
